Polk County, Texas – A body Missing 11-year-old girl from Livingston, Audrey Cunningham, was found Tuesday in the Trinity River near U.S. 59, officials said. Cunningham was issued an Amber Alert on February 15.

A person of interest in the disappearance, Don Steven McDougall, 42, was arrested on Feb. 16 on an unrelated charge of aggravated assault. He was named a person of interest after witnesses linked his dark blue 2003 Chevrolet Suburban to the case.

The Polk County Sheriff's Office said Cunningham was supposed to have caught the school bus at her neighborhood bus stop Thursday last week, but school officials told the sheriff's office the school bus did not pick Cunningham up and she did not go to school.

Investigators said McDougal lived in a camper behind the home of Cunningham's father and grandmother. Sometimes he took her to the bus stop or school if she missed it.

During a news conference Tuesday, Polk County District Attorney Shelly Sitton said she was preparing an arrest warrant for McDougal seeking the death penalty in Cunningham's death.

Authorities have not released Cunningham's cause of death; However, they said his body was being sent to the Harris County Medical Examiner's Office.
